Terms of service
Last updated: September 2026
These Terms of Sale and Website Use (“Terms”) govern your use of RubberMulchOutlet.com and purchases, quotes, projects, and services provided by River City Play Systems LLC, doing business as Rubber Mulch Outlet (“Rubber Mulch Outlet,” “we,” “us,” or “our”). By using the website, submitting an order, accepting a quote, or purchasing a product or service, you agree to these Terms and the policies referenced below.
1. Customer Authority
You must be legally able to enter into a binding agreement. If you act for a business, school, government entity, nonprofit, contractor, property owner, or other organization, you represent that you are authorized to act for that organization and approve the purchase, configuration, delivery, and project information submitted.
2. Website and Product Information
We work to keep product descriptions, specifications, pricing, availability, lead times, images, documents, certifications, and other information accurate. Commercial products may vary by model, configuration, color, mounting method, manufacturer revision, and intended application. Images may be representative and may not show the exact selected configuration.
Before approving an order or project, the customer is responsible for reviewing the applicable quote, order acknowledgement, selected options, dimensions, use zone, mounting method, color, quantity, delivery requirements, and available manufacturer documentation. Contact us before ordering if a detail is material to your project and is not clearly confirmed in writing.
Planning tools, calculators, comparison tools, project builders, downloadable product sheets, and general guides provide preliminary assistance. They do not replace a site-specific design, current manufacturer instructions, professional advice, permit review, or the final written order documents.
3. Quotes, Checkout, and Order Acceptance
A website checkout confirmation acknowledges that we received the order; it does not by itself confirm final acceptance, availability, freight method, delivery requirements, or project suitability. We may review product selection, configuration, pricing, availability, freight, receiving information, tax status, payment method, and other order details before accepting and releasing the order.
An order becomes accepted when we issue a written order acknowledgement, accept the customer’s signed quote or purchase authorization, capture payment, begin approved procurement or production, or otherwise confirm acceptance in writing. We may contact the customer to correct or confirm information before acceptance.
If a product is unavailable, materially mispriced, incorrectly described, incompatible with the submitted configuration, or cannot reasonably be delivered as ordered, we may propose a correction or alternative. If we cannot accept the order and no acceptable revision is agreed upon, we will cancel the affected item and return amounts paid for it.
Quotes expire on the date stated in the quote. If no expiration date is stated, pricing and availability remain subject to confirmation until the quote is accepted. A quote is not a reservation of inventory, production capacity, freight capacity, or installation scheduling unless it expressly says otherwise.
4. Controlling Documents and Changes
The accepted written documents control the products and services purchased. If documents conflict, the following order of priority applies: a later signed change order; the accepted quote or written order acknowledgement; product- or project-specific written terms; these Terms; then the general website content and policies incorporated by reference.
Customer purchase-order terms, vendor-portal terms, or other customer boilerplate do not modify or replace our accepted terms unless we expressly agree to the specific change in a writing signed by an authorized representative of River City Play Systems LLC.
Changes requested after acceptance require our written approval and may change pricing, lead time, freight, installation scheduling, or other requirements. We may issue a revised order acknowledgement or change order before proceeding.
5. Pricing, Taxes, and Payment
Prices are shown in U.S. dollars unless stated otherwise. Listed product pricing includes only the identified product and selected configuration unless a written quote expressly includes freight, installation, surfacing, borders, site work, taxes, or another item.
Applicable taxes are the customer’s responsibility. A customer claiming an exemption must provide valid documentation before invoicing or payment processing is completed. We may correct taxes when required by law or when exemption documentation is missing, invalid, or does not apply to the transaction.
Card orders may be authorized before final order review and captured after the order details are confirmed. ACH and check payments must clear before procurement, production, or release unless we approve different written terms. Purchase orders, deposits, progress payments, retainage, net terms, or other commercial credit terms apply only when expressly approved in writing. The customer remains responsible for payment regardless of its internal approval, reimbursement, grant, or funding process.
Financing is offered only through applicable third-party programs, is subject to lender approval and terms, and is not guaranteed by Rubber Mulch Outlet.
6. Lead Times, Availability, and Delays
Lead times are estimates, not guaranteed delivery or completion dates, unless a written agreement expressly states otherwise. An estimated lead time begins after order acceptance, required payment or deposit, final configuration approval, and receipt of information needed to proceed.
Quick Ship and standard lead-time designations are subject to current availability, configuration, and manufacturer capacity. Backorders, custom colors, revisions, freight availability, weather, site readiness, permitting, supply conditions, and events outside reasonable control may affect timing. We will communicate material known changes and work reasonably to coordinate the order.
7. Shipping, Delivery, and Receiving
Shipping, freight, delivery appointments, unloading, inspection, damage reporting, shortages, customer-caused carrier charges, and related responsibilities are governed by our Shipping & Freight Policy, which is incorporated into these Terms.
Please always accept the shipment. Do not refuse any delivery. Acceptance preserves the ability to document damage, shortages, or other delivery issues and does not waive an appropriately documented claim.
8. Returns, Cancellations, Claims, and Refunds
Return eligibility, cancellation requests, delivery claims, customer-caused freight charges, payment-processing costs, and refunds are governed by our Returns, Cancellations & Refunds Policy, which is incorporated into these Terms.
9. Installation and Project Services
Installation or project services are provided only when expressly included in an accepted written quote or order. The written scope controls. Equipment assembly, anchoring, unloading, material movement, surfacing, borders, accessible entry components, demolition, grading, excavation, base preparation, hauling, permits, inspections, restoration, and other work are separate components and are included only when specifically described and priced.
If Rubber Mulch Outlet includes installation or project services on its accepted quote or invoice, the customer contracts with Rubber Mulch Outlet for that stated scope. We may perform the work through qualified employees or independent subcontractors and remain responsible to the customer for the contracted scope. If an installer or other service provider issues a separate quote or agreement directly to the customer, that provider—not Rubber Mulch Outlet—is the contracting party for that separate work, and its agreement and warranty terms control.
Limited removal, grading, base work, excavation, hauling, permitting, or restoration may occasionally be offered as an individually described and priced service. No such work is included by implication.
10. Site Readiness and Customer Responsibilities
Unless the accepted written scope expressly states otherwise, the customer is responsible for:
- accurate site, access, delivery, utility, and project information;
- ownership authorization and approvals from landlords, boards, schools, municipalities, or other responsible parties;
- permits, inspections, surveys, engineering, accessibility review, and compliance requirements;
- locating and marking public and private utilities, irrigation, drainage, septic, electrical, communication, and other concealed conditions;
- adequate grading, drainage, soil, base, access, security, and storage conditions;
- removal or protection of obstacles and maintaining a safe, accessible work area; and
- ongoing inspection, maintenance, surfacing depth, and safe operation after completion.
Unexpected or inaccurate site conditions, unavailable access, unmarked utilities, customer delays, work by others, or changes in applicable requirements may require a change order, additional charges, rescheduling, or remobilization. We will describe and price material additional work before proceeding when reasonably practical.
11. Installation Workmanship Warranty
When installation is sold directly by Rubber Mulch Outlet, we warrant the covered installation workmanship for one year after substantial completion. Our obligation is limited to inspecting and correcting or reperformance of covered installation work that did not conform to the accepted written scope or applicable manufacturer installation instructions in effect when the work was performed.
The customer must notify us promptly after discovering a claimed workmanship issue and provide reasonable access, photographs, records, and an opportunity to inspect and correct the work. This workmanship warranty does not cover product or manufacturer defects; ordinary wear; maintenance; misuse, abuse, vandalism, or unauthorized modification; work performed by others; drainage, erosion, settlement, soil movement, frost, weather, vegetation, utilities, or concealed site conditions; customer-provided materials or information; or damage outside our reasonable control.
If the customer contracts directly with an installer, any workmanship warranty is provided solely under that installer’s agreement.
12. Product Warranties and Support
Product warranties vary by manufacturer, product, configuration, use, installation, and maintenance. Any manufacturer warranty is subject to the manufacturer’s current written terms, exclusions, claim procedures, and remedies. A warranty headline or summary on the website does not expand the manufacturer’s written warranty.
We will reasonably assist with applicable product and manufacturer claims. Unless an accepted written agreement or applicable warranty expressly provides otherwise, warranty coverage does not include labor, removal, reinstallation, freight, site restoration, downtime, or other incidental project costs. Replacement parts or products do not automatically extend the original warranty period.
13. Safety, Compliance, and Professional Review
Product standards, certifications, accessibility features, fall-height ratings, use zones, surfacing requirements, and code obligations vary. The customer is responsible for confirming that the final product, site design, installation, surfacing system, and ongoing maintenance satisfy the requirements applicable to the specific project and location.
Rubber Mulch Outlet does not provide architectural, engineering, legal, code-enforcement, or safety-inspection services unless an accepted written agreement expressly identifies a qualified professional service. General guidance and manufacturer information do not replace review by the customer’s responsible design professional, authority having jurisdiction, certified playground safety inspector, or other qualified adviser when required.
14. Customer Materials and Privacy
The customer retains ownership of plans, drawings, photographs, specifications, logos, and other materials it submits. The customer grants us a limited license to use and share those materials as reasonably necessary to evaluate, quote, fulfill, deliver, install, support, or administer the requested project or order.
Our collection, use, disclosure, retention, and permitted de-identified educational use of personal and project information are described in our Privacy Policy.
15. Acceptable Website Use
You may use the website for lawful product research, purchasing, project planning, and communication with us. You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape or copy substantial portions for a competing commercial purpose, misrepresent your identity or authority, submit unlawful or infringing material, or use the website to violate another person’s rights.
Website text, graphics, page designs, tools, and original materials are owned by or licensed to Rubber Mulch Outlet and are protected by applicable intellectual-property laws. Manufacturer names, trademarks, images, and documents remain the property of their respective owners.
16. Third-Party Services and Links
The website may provide access to third-party services, financing, manufacturer documents, social networks, or external links. Those third parties control their own services and terms. We are not responsible for third-party content or services outside the products or responsibilities expressly included in our accepted agreement.
17. Disclaimers and Limitation of Liability
Except for express written product warranties, the workmanship warranty above, and rights that cannot lawfully be excluded, the website and general informational materials are provided on an “as available” basis. We do not guarantee uninterrupted website access or that general planning information will fit every site or project.
To the fullest extent permitted by law, neither party will be liable to the other for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, loss of use, or project delay, arising from the website, an order, or a service. This exclusion does not apply to payment obligations, misuse of intellectual property or confidential information, indemnity obligations, fraud, gross negligence, willful misconduct, or liability that cannot lawfully be limited.
To the fullest extent permitted by law, our aggregate liability arising from an affected product or service will not exceed the amount paid to us for that affected product or service. This limitation does not reduce any remedy expressly provided by an applicable written warranty or accepted written agreement and does not apply where prohibited by law.
18. Customer Responsibility and Indemnity
To the fullest extent permitted by law, the customer is responsible for claims, losses, or costs resulting from inaccurate customer information, an unsafe or unprepared site, unmarked utilities, customer-directed deviations, unauthorized modification, misuse, inadequate inspection or maintenance, failure to preserve required surfacing, or violation of law by the customer or its contractors.
The customer will defend and indemnify River City Play Systems LLC and its officers, employees, and agents from third-party claims arising from those customer-controlled conditions, except to the extent caused by our negligence, willful misconduct, or breach of the accepted agreement.
19. Events Outside Reasonable Control
Neither party is liable for delay or failure caused by events outside its reasonable control, including severe weather, natural disaster, fire, epidemic, labor disruption, carrier interruption, government action, material shortage, manufacturer delay, utility interruption, civil disturbance, or similar event. Payment obligations for products or services already provided are not excused. The affected party will use reasonable efforts to communicate and reduce the impact.
20. Governing Law and Venue
These Terms and transactions with Rubber Mulch Outlet are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any lawsuit arising from these Terms or an order or service must be brought in a state court with jurisdiction in Comal County or Bexar County, Texas, or in the United States District Court for the Western District of Texas, San Antonio Division. Each party consents to that jurisdiction and venue.
21. General Terms
If a provision is found unenforceable, the remaining provisions remain in effect and the affected provision will be enforced to the maximum extent permitted. A waiver must be in writing and applies only to the specific circumstance stated. Headings are for convenience and do not limit the provisions.
The customer may not assign an accepted order or agreement without our written consent, except as part of a permitted transfer of the applicable property or organization with written notice and assumption of the customer’s obligations. We may assign our rights and obligations as part of a merger, reorganization, sale of business or assets, or to an affiliate or successor.
We may update these Terms prospectively by posting a revised version and changing the “Last updated” date. The version in effect when an order is accepted governs that order unless the parties agree otherwise in writing.
